A man who had a heart attack following the false missile alert in Hawaii is suing, reports the Associated Press.????James Sean Shields claims in the lawsuit that his heart attack on January 13th was caused by the mistakenly issued alert about a ballistic missile headed towards the Aloha State.

????Shields and his girlfriend, Brenda Reichel are suing the state of Hawaii and the former administrator of the Hawaii Emergency Management Agency, Vern Miyagi who resigned amidst the fallout from the false alert.????(vo 4)????On January 13th, the state’s emergency management accidentally issued a missile alert to cell phones and broadcasters during what was supposed to be a drill.??Citizens on the island were panicked before the state notified them 38 minutes later that it was a false alarm.????Following the first alert, Shields and his girlfriend were calling loved ones and driving to the beach when the cardiac episode occurred.

The lawsuit claims the state’s failure to cancel the alert in a timely was a substantial factor for Shields’ heart attack.

The couple are seeking unspecified damages.
