Judge: Walmart Should Have Been Paying Its Drivers For Breaks All Along

Walmart truck drivers should have been paid for their rest breaks, and now the company is going to have to pay up.

According to Business Insider, the drivers are the latest to win in federal court for unpaid rest breaks.

The US Ninth Circuit Court of Appeals just affirmed that Walmart will need to pay its California truck drivers $54.6 million.

A company spokesman says their drivers are among the best paid in the business, and would explore options to challenge the opinion.

Nationwide, truckers are required to take a 30-minute break during their workday and not drive for more than 11 hours in a day.

But that rest time isn't usually paid — because truckers are usually paid per mile, not per hour.

Increasingly, federal judges are saying that violates labor law.
