Court rules against Gov. Brown's executive order

We have complete team coverage..starting with kezi nine news reporter connor mccarthy... live in the studio with the latest on that legal drama that's playing out in salem as we speak.

Connor... this is big.

Matt--we learned in the last few minutes brown has appeadled to the state supreme court.

Today's ruling in a baker county courtroom effectively cancels all of brown's exectuive orders issued during the pandemic.

Technically this means all of oregon is back open and there is*nothing restricting oregonain's movements.

Ray hack-e represents 10 churches-- including one in roseburg-- that sued the governor over their right to gather for religous services.

They said limiting church to 25 people or less was unconstitutional.

But the decision by judge matthew shirtcliff's ruling in favor of the churches not only allows people to gather for service.... but it also strikes down all of the stay at home order and opens up the state.

Shirtcliff said under state law... brown can only declare an emergency for 30 days.

In her orders they never even reflect that she paid no mind to the constitution.

I don't know whether if that was based on ignorance on her part or whether it was deliberate.

Her initial order declaring the emergency said it would be in effect for 60 days hack-e says there is nothing in the oregon consitution that gives brown the power to have an emergency declaration that long.

In fact... anything beyond 30 days needs to be aprroved by three fifths of the legislature.

Matt-- the governor's office filed an emergency appeal with the oregon supreme court.

So right now... the state is open... but we are in a limbo until the supreme court makes their ruling.

The governor says she hopes a ruling can come as soon as possible.
