The Committee on Alabama Monument Protection said request "should be directed to the Office of the Alabama Attorney General."

New tonight -- we learned the request by the madison county commission to relocate the confederate monument downtown has been rejected!

It was sent to the committee on alabama monument protection last month.

The county commission unanimously voted back in june to seek a waiver from the committee.

In an email contained by waay31 -- the commission was told its request to relocate the monument was outside the scope of authority granted to the committee.

The committee is only permitted to hear cases for historical structures that have been in place between 20 to 40 years.

The statue outside the huntsville courthouse has been there since 1905.

Steve murray -- the director of the alabama department of archives and history -- says that further inquiries should be directed to the office of the alabama attorney general.

In order to move the monument -- either the county or city will be faced with a 25-thousand dollar fine.

Huntsville city council did approve a resolution last onth to relocate the monument to historic maple hill
